Illinois law now permits recovery for grief in wrongful death cases. This represents a change in the existing law. In addition to grief, damages for loss of society and companionship are recoverable under Illinois law as well.
The Illinois Wrongful Death Act permits recovery for loss of a family member due to the negligence of another.
These cases require a careful presentation of the close and loving relationship between the deceased and the surviving family members. All witnesses, documents, photographs, and other evidence which depict that relationship are presented.
